General Terms and Conditions

Part I — Website and Platform Terms

1. Scope and Acceptance

These General Terms and Conditions apply to all users of the SeaSpots platform.

By creating a user account, submitting a booking request, or otherwise actively using the booking and communication features, you agree to these Terms and Conditions.

For purely informational visits without use of interactive features, these terms are not deemed incorporated.

2.3 Role of the Platform

SeaSpots is a digital platform for presenting listings and supporting communication and booking organisation.

SeaSpots AS does not act as a tour operator. Any facilitation is provided exclusively in a technical capacity.

Contracts for listed services are concluded exclusively between the user and the provider.

3. Contract Formation Between User and Provider

The presentation of listings on the platform does not constitute a legally binding offer, but an invitation to submit an offer.

By submitting a booking request, the user makes a binding offer to the respective provider.

The contract is only concluded when the provider expressly accepts this offer, in particular by confirmation via e-mail or through the platform.

4. Protection of Database and Intellectual Property

All compilations of content are protected by copyright and database law.

5. Permitted Use

Permitted uses include:

  • Access via standard commercial browsers
  • Contacting providers
  • Use of the designated booking features

6. Prohibited Use

The following are expressly prohibited:

  • Automated scraping of the platform
  • Competitive analysis
  • Circumventing technical protection measures

7. Technical Protection Measures

Access restrictions and security mechanisms are in place.

8. Consequences of Violations

In the event of violations, we reserve the right to block access and take legal action.

Part II — Content, Payment and Liability

10. Prices and Payment Processing

Prices are determined by the respective providers' listings.

Payments are made exclusively directly between user and provider.

SeaSpots AS does not accept payments and is not a payment service provider.

11. Third-Party Content

Providers are solely responsible for their content.

We do not review provider content for accuracy, completeness or legality and assume no warranty or liability in this regard.

12. Cancellation and Withdrawal

Cancellation and withdrawal terms are governed by the respective providers' listings.

The platform operator accepts no responsibility in this regard.

Any statutory rights of withdrawal remain unaffected.

13. Limitation of Liability

We are liable without limitation for intent, gross negligence and for damages to life, body or health.

For simple negligence, we are liable only for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable, typical contractual damage.

All other liability is excluded.

Part III — Final Provisions

14. Applicable Law and Jurisdiction

Norwegian law applies.

Mandatory consumer protection provisions of the country in which the user is habitually resident remain unaffected.

The exclusive place of jurisdiction for merchants and legal entities is the registered seat of SeaSpots AS.

For consumers, the statutory places of jurisdiction apply.

15. Amendment of Terms

Amendments to these terms will only be made for legitimate reasons, in particular changes in law, technical developments or expansion of features.

Amendments will be notified at least six weeks before taking effect, by e-mail or via the platform.

Users may object within four weeks.

If a user objects, the user relationship may be terminated.

16. Online Dispute Resolution

The European Commission provides an online dispute resolution platform:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
